Nick Reiner will not be handed the death penalty if found guilty in last year’s killing of his parents, Hollywood power couple Rob and Michele Singer Reiner, prosecutors confirmed on Tuesday.
Nick has been in jail in downtown Los Angeles since his filmmaker father and photographer mother were discovered lifeless in their Brentwood home on December 14, 2025.
The Reiners’ middle child is awaiting a 2027 trial for two counts of murder and a special allegation he used a knife as a deadly weapon.
He is also alleged to have lain in wait before committing the crime.
The 33-year-old denies all charges against him.
Life without parole on the table
If convicted, Nick may spend the remainder of his life behind bars without the possibility of parole, the Los Angeles District Attorney’s Office said in a statement.
District Attorney Nathan Hochman said the prosecution decided to rule out the death penalty against Nick after conducting a “thorough review” and speaking with the screenwriter’s two siblings, Jake and Romy.
“This decision reflects our careful judgment about the most appropriate path to take in this case and does not diminish the severity of these crimes,” Hochman said.
“I have spoken to the Reiner family and evaluated the mitigating and aggravating factors that are part of special circumstance murder cases.
“Seeking capital punishment should be reserved for the most egregious instances, and we determined after a thorough review that the death penalty was not the appropriate resolution in this case.”
Los Angeles Deputy Public Defender Kimberly Greene welcomed the prosecution’s decision while highlighting her client’s struggles with drug addiction and mental health.
“Nick has a serious mental illness and a long history of struggling with self-medicating,” she said.
“His circumstances are a tragic example of how difficult it can be for people experiencing significant mental health challenges to access and navigate the treatment and support they need.”

Rob Reiner wins posthumous Emmy
Tuesday’s decision came a day after the 2026 Emmy Awards paid an emotional tribute to the Reiner patriarch and other figures who recently passed away, including Catherine O’Hara, Dolly Parton, Eric Dane, Tim Curry, and Hayden Panettiere.
Actress Jamie Lee Curtis was unable to hold back her tears on stage as she remembered Rob, whom she worked with on the sitcom “New Girl”.
“Last year, we lost another cherished legend, our beloved ‘Meathead,’ Rob Reiner,” she said, referring to Rob’s role as Michael ‘Meathead’ Stivic on ‘All in the Family’.
“He was generous and kind and funny as hell and a friend to all.”
Last week, Rob won a posthumous Emmy award for outstanding guest actor in a comedy series for his role as a restaurant consultant on ‘The Bear’.
The comedic legend bested fellow nominees Michael J. Fox and Brett Goldstein (‘Shrinking’), Hamish Linklater (‘Widow’s Bay’), Christopher McDonald (‘Hacks’), and Connor Storrie (‘Saturday Night Live’).
This was his first Emmy since 1978, when he bagged two awards for his performance on ‘All in the Family’. It was also the longest gap between Emmy wins, a record previously held by his father, Carl Reiner, for 37 years.
